Acceptance of Terms of Usage

The Terms of Usage (defined below) govern your access and usage of this website. By accessing or using this website, you agree to be bound by the Terms of Usage and any additional restrictions pertaining to the Terms of Usage specified in different sections of this website.

Acceptance of Terms of Sale & Service

The Terms of Sale & Service (defined below) outline the conditions you agree to abide by when requesting or receiving products or services from PICO Designs Inc. (hereon referred to as ‘PICO Designs’). By requesting or agreeing to receive products or services from PICO Designs, you agree to be bound by the Terms of Sale & Service and any additional restrictions pertaining to the Terms of Sale & Service specified in different sections of this website.

 

Terms of Usage

PICO Designs reserves the right to make changes to all sections of this website at any time without prior notice. You must review the Terms of Usage before each visit to this website to understand our updated policy.

 

You also agree that by signing up to receive communications anywhere on this website, you are giving PICO Designs the right to send you communications (including, but not limited to, information about products, services, promotions, contests, giveaways, and surveys; special discounts; and general business updates) to the email address you provide us. You may withdraw your consent by contacting picodesignsinc@gmail.com and clearly stating that you would like to unsubscribe from all communications in the subject. Please note that it may take up to 6 weeks to remove you from our contact list.

Terms of Sale & Service

Order Acceptance

All orders are subject to acceptance by PICO Designs. We reserve the right to reject any order at any time without recourse, even after accepting the order. The ‘Order Confirmation’ email is an acknowledgement that we have RECEIVED your order and does not confirm acceptance of the order. PICO Designs only accepts your order once we have received the deposit in its entirety. Additionally, we reserve the right to change the quoted price at any time, even after accepting the order.

 

Quotes

All quotes are an estimation of the cost of product(s) or service(s). PICO Designs does not guarantee the cost or product(s) or service(s). The final cost of any product(s) or service(s) is outlined in the Invoice sent to you by PICO Designs. All quotes are exclusive of taxes and shipping. Quotes are valid for up to 30 days after being generated.

 

Excess Work

Excess Work includes any additional labour, product(s) or service(s) that are provided to you in addition to the work outlined in the ‘Order Confirmation’ email. Excess Work is incremental to the product(s) or service(s) signed off or confirmed by you. Excess Work includes, but is not limited to, additional revisions made based on your feedback, additional product(s) or service(s) requested by you, and additional product(s) or service(s) necessary to complete the work outlined in the ‘Order Confirmation’ email. Wherever or whenever possible, PICO Designs will notify you of increases in cost to you. However, PICO Designs reserves the right to proceed with Excess Work without prior consent or approval from you.

 

Approval of Final Artwork

While PICO Designs proofreads all work to avoid errors, PICO Designs will not be held responsible for any spelling mistakes, typos, or incorrect information. You are responsible for proofreading all artwork and approving it before it is sent for printing. Once artwork is sent for printing (with or without errors), it is your responsibility. You are still required to pay the order total in full despite any errors.

 

Payment Terms & Conditions

 

Deposit:

Printing Orders: You agree to pay a 50% deposit of the quoted amount in the ‘Order Confirmation’ email to commence any work, with the balance payable prior to the order being sent for printing. Once PICO Designs invests any type of resources into your order (including, but not limited to, labour resources and financial resources), your deposit is non-refundable.

Non-Printing Orders: You agree to pay a 100% deposit of the quoted amount in the ‘Order Confirmation’ email to commence any work. Once PICO Designs invests any type of resources into your order (including, but not limited to, labour resources and financial resources), your deposit is non-refundable.

 

Cancellation:

At PICO Designs we hope to provide services that surpass your needs and expectations. However, if you decide that you do not wish to continue working with PICO Designs and wish to cancel your order for any reason, or if PICO Designs cancels your order BEFORE 50% of your order is completed, this deposit is non-refundable. If you decide that you do not wish to continue working with PICO Designs and wish to cancel your order for any reason, or if PICO Designs cancels your order AFTER 50% of your order is completed, this deposit is non-refundable and a prorated payment for labour spent on your order will be payable to PICO Designs. The prorated rate of labour for all cancelled orders is $30/hour. Additionally, if PICO Designs is not contacted by you within 14 days (or 10 business days) of sending your Invoice, we reserve the right to cancel your order.

 

Release of Work:

PICO Designs will NOT release any original digital files to you (including, but not limited to, .psd, .ai and .indd). We reserve the right to share digital files with you in any format. PICO Designs maintains ownership of all original artwork and copyrights until ownership is explicitly transferred (must be captured in writing and signed by an authorized employee at PICO Designs). Ownership of artwork will only be extended to you when you purchase the original artwork files from PICO Designs at an additional cost (in additional to the order total). Your Invoice must be paid in full before your order is sent for printing. Once we have received your payment in its entirety, we will send your order for printing. If you are unable to pay your Invoice for whatever reason, you must notify PICO Designs within 2 business days of receiving your Invoice. If PICO Designs is not contacted by you within 2 business days of you receiving your Invoice, we reserve the right to cancel your order (see ‘Cancellation’ terms above).

 

Payment Declined:

If your payment is declined for whatever reason, PICO Designs will not accept your order. Please try again or notify PICO Designs if the issue persists. We will try our best to support you throughout the process.

 

Due Date & Interest Charge:

Your payment is due in its entirety before your order is sent for printing. If, for whatever reason your order has been sent for printing or has been shipped to you AND you have not paid your Invoice in its entirety, you agree to paying a 2% monthly interest rate (24% annual interest rate) on the outstanding balance and agree to pay within 30 days of your order being sent for printing. Interest will be calculated from the day your order was sent for printing. If you have not paid the outstanding balance and interest within the 30 days payment period, PICO Designs reserves the right to seek recovery of the outstanding balance via collection agencies and/or through the Small Claims Court of Ontario in the event that the outstanding amount does not exceed the current Small Claims Court of Ontario limitations. In such circumstances, you shall be liable for any and all additional administrative and/or court costs. If you have not paid the outstanding balance and interest within the 30 days payment period, PICO Designs also reserves the right to cancel all future orders with you and/or request payments for future orders in advance before any resources are invested into the order (including, but not limited to, labour resources and financial resources).

 

Discrepancies

 

Colour Quality:

PICO Designs is not able to control, nor is responsible for any colour shift for files that are sent for printing as colours will not print exactly as shown on digital screens. Proofs sent to you by PICO Designs may not print exactly as shown due to RGB to CMYK conversion. Proofs are only used to confirm with you the design, layout and text accuracy, and should not be used to assess colour or ink density. Additionally, any coating (including, but not limited to, matte, gloss and soft touch) to printed materials may influence or change the appearance of printed colours. PICO Designs is not able to control colour change caused by coating and will not take responsibility for such discrepancies.

 

Incorrect Orders:

If you have been shipped or sent an incorrect order(s) or product(s) (different from the order(s) or product(s) outlined in the ‘Order Confirmation’ email), please contact picodesignsinc@gmail.comwithin 48 hours of delivery. Your order will be corrected at no additional cost to you.

Shipping & Delivery

 

Delivery:

When you place an order with PICO Designs, we do our best to create, print, ship, and deliver your product(s) to you as soon as possible. PICO Designs does not at any time guarantee a specific delivery date or time. All delivery dates are only an estimate and should not be considered exact. Delivery dates are dependent upon many factors, including your cooperation throughout the process. If you are unable to provide feedback or approval by the specified date(s), delivery of your order will be delayed. PICO Designs reserves the right to choose any shipping carrier for any order to ensure the best possible experience.

 

Shipping & Delivery Costs:

You will be responsible for the shipping, handling and delivery costs for your order.

 

Damaged Products:

PICO Designs will not be responsible for any lost, damaged, or undelivered order(s) while the order is with the shipping carrier. If any product arrives damaged, please contact picodesignsinc@gmail.comwithin 48 hours of delivery. You will be asked to either (1) provide us with pictures or (2) return the item within 72 hours of receipt. Please ensure you keep the product(s) and its packaging contents in case they are required to assess your claim. PICO Designs will determine whether you will be refunded or if we will replace the damaged product(s).

 

Holidays & Extreme Weather Conditions:

During these time periods, PICO Designs cannot be held accountable for shipping delays. Holidays (identified on our website) are considered exceptionally busy periods due to high volumes, so please place your order in advance and allow 2 additional business days for delivery before raising a query. Additionally, during extreme weather conditions, please allow 3 additional business days for delivery before raising a query. If you have still not received your order after accounting for the additional days, please contact picodesignsinc@gmail.com and our team will be happy to support you.

 

Customer/Client Feedback

PICO Designs welcomes all feedback about our products and services so we can continue to improve your experience. If you have any complaints or would like to share any feedback, please contact picodesignsinc@gmail.com clearly stating that you have a complaint or are sharing feedback in the subject. We will do our best to deal with any complaints requiring immediate assistance within 10 business days.

 

Return Policy

All PICO Designs’ sales and services are final. There are no returns or exchanges allowed. Each order is inspected and shipped by us personally and will not be shipped with any defects. Please be sure about your purchase before confirming your order.

 

Warranty Policy

PICO Designs does not provide warranty on any of its products. We also do not guarantee the replacement of defective or incorrect products, nor do we provide credits or refunds on such products.

 

Circumstances Beyond Our Reasonable Control

PICO Designs will not be held responsible for any delay or failure to comply with our obligations under these ‘Terms of Sale and Service’ if a delay or cancellation arises from any circumstance that is beyond our reasonable control. In such circumstances, the deposit will be forfeited to compensate PICO Designs for costs pertaining to labour resources and financial resources. Additionally, PICO Designs will maintain ownership of all original artwork and copyrights.

Limitation of Liability

In no event will PICO Designs or our licensors, suppliers, vendors, officers, directors, employees, or agents be liable for any incidental or consequential damages in contract or in tort (including negligence) to the customer/client whatsoever. This includes damages resulting from loss of use, data, or profits, whether or not PICO Designs was advised of the possibility of damage. The customer/client agrees to not hold PICO Designs responsible for any damages, expenses, costs and losses, including legal costs, pertaining to any claims or proceedings that may be instituted against PICO Designs or our licensors, suppliers, vendors, officers, directors, employees, or agents on grounds claiming that our work violates any copyrights, trademarks, service marks, trade secrets, patents or invades any individual’s or organization’s right to privacy or other personal rights. The customer/client also agrees not to make claims against PICO Designs on grounds of production or delivery delays, labour costs, financial investment costs or non-productive overtime.

Intellectual Property Rights

PICO Designs’ copyrights, trademarks, service marks, patents and artwork as used on our website and across various digital touchpoints (including, but not limited to, Instagram, Facebook and LinkedIn) are protected by national law. Any unauthorized use or reproduction (with variation) of legally protected assets or any content on our website is strictly prohibited. Authorized use must be obtained through written and signed permission by an authorized employee at PICO Designs. PICO Designs also retains full ownership of all artwork and materials (including, but not limited to, proposals, concepts, sketches, drafts, original files, fonts, stock images, colour palettes) produced by our organization, whether the artwork and materials are used or unused by the customer. Ownership of artwork will only be extended to you when you purchase the original artwork files from PICO Designs at an additional cost (in additional to the order total). PICO Designs reserves the right to use stock images in all artwork, and the cost of accessing these assets will be paid by the client, even if it is not outlined in the ‘Order Confirmation’ email. All artwork provided by PICO Designs should only be used for the client’s said purposes as identified in writing. Any additional usage of the artwork will require prior approval by PICO Designs and be subject to additional costs which will be assessed by PICO Designs. PICO Designs maintains the right to feature all artwork and materials produced by our organization on our website or in any of our marketing/advertising (including, but not limited to, Instagram, Facebook, LinkedIn, and Google Business Profile).

Privacy Policy

What We Collect

PICO Designs ­­­respects your privacy rights and ensures that we put in our utmost effort to protect your personal information. PICO Designs collects the information you provide to us when you request a quote, place an order, sign up for communications, participate in a contest or giveaway, or complete a survey. This includes, but is not limited to, ­­name, sex, date of birth, telephone number, email and address. In order to improve your experience, PICO Designs also keeps record of customer/client buying patterns, including marketing interactions, product preferences and channels of purchase. Personal information collected by PICO Designs may be given to third parties ONLY IF they are involved in completing your order. PICO Designs WILL NOT by any means sell your personal information to a third party. By engaging in any of the above-mentioned activities, you agree to and accept the use of your personal information for all purposes by PICO Designs.

 

How We Use Your Information

PICO Designs will use your information to process your order. We will use this information for sending you an email confirmation, giving you a call, or mailing you a note that we have received your order, your order has been confirmed, your order is under progress, your order has been shipped, or that your order has been delivered. By providing us your email, you will be automatically signed up to receive emails regarding our products, services, promotions, contests, giveaways, and surveys. You may unsubscribe from receiving email updates that do not directly relate to your order by contacting picodesignsinc@gmail.com and clearly stating that you would like to unsubscribe from email communications in the subject. Please note that it may take up to 6 weeks to remove you from our mailing list. Additionally, we may combine information provided by you from various sources or channels. We also may profile you into certain segments and demographics to provide you with the best offers and communications. If you would not like your information used for this purpose, please contact picodesignsinc@gmail.com and clearly state that you would not like your information combined for segmentation in the subject. Please note that it may take up to 6 weeks to remove you from this process. As mentioned earlier, in order to improve your experience, PICO Designs also keeps record of customer/client buying patterns, including marketing interactions, product preferences and channels of purchase. We may use this information for various business improvement activities, such as improving product offerings, modifying website design, or improving supply chain operations.
